There is NO law that states the Owner-Operator gets 100% of the fuel surcharge. You pay for your fuel for your truck and the company can take all or part of the Fuel Surcharge. These companies and brokers that say "The fuel surcharge is in the rate" BEWARE! Owner-operators need to neogotiate to have the Fuel Surcharge paid 100% to them in their Lease. At the present time, having an agreement in writing with your carrier is the only legal means of getting 100% of the Fuel Surcharge. You're the one that pays for the fuel, you deserve 100% of the Fuel Surcharge! In the meantime join www.OOIDA.com and write your Congressman and tell them to pass legislation for the person who pays for the fuel is the only one who is entitled the Fuel Surcharge.
